Samsung/Apple trial by jury begins today, don?t expect a clear outcome anytime soon

Following months of legal wrangling, injunctions and appeals, Samsung and Apple will face off in a federal court in San Jose today. The two companies accuse each other of patent and design infringement, with Apple seeking more than $ 2.5bn in damages, and Samsung looking to claim royalties for five of its own patents.

The narrative is all too familiar ? Apple accuses Samsung of being a "copycat" and imitating its products and inventions rather than inventing its own. Samsung counters that Apple's claims are overly broad, and that its actions are?anti-competitive and monopolistic.

Apple will argue that Samsung has copied its patented designs, and that Samsung's products, in both hardware and software, are "confusingly similar" to the iPhone and iPad. It's a tactic which has been met with some success, notably in the German courts, over the past year. However, it's backfired in the UK, where a High Court judge recently ruled that Samsung did not copy Apple's iPad designs, and ordered Apple to take out ads to this effect.

So we're in for yet more claims and counterclaims, with the certainty of appeals to follow whatever verdicts the court reaches. So strap yourself in, and prepare for endless?back and forth lawyerin' over the coming weeks. As our own Jerry Hildenbrand noted in his recent editorial, this is just the way things have to be in the mobile tech world in 2012. Let's just hope that whatever the decision, it doesn't impact consumers' freedom to choose the phone they want.

Tanzanian teachers in strike over pay

DAR ES SALAAM (Reuters) - Tanzanian teachers went on strike on Monday to push for better pay joining doctors in demanding higher salaries as rising costs of living threaten to stoke social tension.

Many public schools across Tanzania were forced to suspend classes as teachers stayed at home.

The teachers' strike comes on the heels of an on-off strike by doctors who have also been demanding salary increases and better working conditions.

About 200,000 teachers in the country voted overwhelmingly for the strike, ignoring a warning from the president that the boycott was illegal, the Tanzania Teachers' Union said in a statement.

"Some 95.7 percent of our members voted in favour of the strike, hence validating the industrial action against the government as their employer," Gratian Mukoba, chairman of the teachers' union said in a statement.

Teachers want a pay hike of more than 100 percent from their current average monthly salary of around 500,000 shillings. The government said it was willing to raise their salaries by about 15 percent in the 2012/13 fiscal year.

Doctors launched another round of strikes last month after talks with the government over better pay and conditions failed to reach a compromise.

Tanzania's year-on-year inflation rate fell to 17.4 percent in June from 18.2 percent a month earlier, but consumer prices remain high in the country.

US audit: $200M wasted on Iraqi police training

BAGHDAD (AP) ? U.S. auditors have concluded that more than $200 million was wasted on a program to train Iraqi police that Baghdad says is neither needed nor wanted.

The Police Development Program? which was drawn up to be the single largest State Department program in the world ? was envisioned as a five-year, multibillion-dollar push to train security forces after the U.S. military left last December. But Iraqi political leaders, anxious to keep their distance from the Americans, were unenthusiastic.

A report by the Special Inspector General for Iraq Reconstruction, released Monday, found that the American Embassy in Baghdad never got a written commitment from Iraq to participate. Now, facing what the report called Baghdad's "disinterest" in the project, the embassy is gutting what was supposed to be the centerpiece of ongoing U.S. training efforts in Iraq.

According to the report, the embassy plans to turn over the $108 million Baghdad Police College Annex to Iraqis by the end of the year and will stop training at a $98 million site at the U.S. consulate in the southern city of Basra. Additionally, the number of advisers has been cut by nearly 90 percent ? from 350 to 36.

"A major lesson learned from Iraq is that host country buy-in to proposed programs is essential to the long-term success of relief and reconstruction activities. The PDP experience powerfully underscores that point," auditors wrote in a 41-page summary of their inspection. An advance copy was provided to The Associated Press.

Auditors noted that it "has clearly been difficult" for American diplomats to secure a solid commitment from Iraq's government to participate in the training program. Still, the report concluded, "the decision to embark on a major program absent Iraqi buy-in has been costly" and resulted in "a de facto waste."

The findings call into question funding needs at the largest U.S. embassy in the world, as the Obama administration prepares its new spending plan for the 2013 fiscal year that begins Oct 1. While auditors said it's unknown how much the embassy in Baghdad is requesting, additional money for the police program "may not be needed."

Despite years and billions of dollars of training, Iraq's police force remains a vulnerable target for militants. On Sunday, seven police were killed and nine more wounded in bombings and shootings near the former al-Qaida stronghold of Fallujah, about 64 kilometers (40 miles) west of Baghdad. It appeared to be the latest strike by the Sunni insurgency as it seeks to reclaim areas where U.S. troops ousted them.

In a July 26 letter responding to a draft of the report, acting Assistant Secretary of State Carol Z. Perez said the embassy will need an unspecified amount of additional funding this year to continue training Iraqi police into 2013. She disputed the finding that the funds have been wasted, noting Iraqis will continue to use the Baghdad Police College Annex for training.

Moreover, Perez said, the embassy has been assured by Principal Deputy Interior Minister Adnan al-Asadi that Iraq is committed to a streamlined version of the training program. U.S. diplomats will continue working with top security officials, she said, "to ensure that our police assistance efforts meet mutual goals and objectives and to sustain senior-level Iraqi commitment to the program."

The auditors, however, said those assurances fall far short of a written commitment, and quoted al-Asadi as telling U.S. inspectors that the police training program is "useless."

Al-Asadi "also indicated that Iraqi police officers had expressed their opinion that the training received to date was not beneficial," the audit said.

Al-Asadi could not immediately be reached for comment Sunday and his spokesman declined to discuss the report. But a key member of parliament's security oversight committee said that U.S. training programs are no longer needed by Iraqi police.

"The Iraqi federal police went through many training courses, in many fields, and that resulted in having many experts and specialist academies," Shiite lawmaker Hakim al-Zamili said. "At this point, we don't need the American expertise, because of the expertise we have now."

Auditors said the U.S. has spent about $8 billion to train and equip Iraqi police since the 2003 U.S.-led invasion. At that time, there were about 58,000 police in Iraq. The report said that number had grown to 412,000 by 2010. Other estimates put the size of Iraq's federal, local and border police force at 650,000.

The training was led by the American military until last October, just six weeks before U.S. troops left Iraq for good. The embassy took over the program, but with what Monday's report described as "mixed results."

Iraq's self-rule northern Kurdish region has embraced the program and, as a result, half of the remaining 36 U.S. advisers assigned to police training will be based in the Kurdish capital of Irbil, 350 kilometers (215 miles) north of Baghdad.

But restive politics in the central government, whose factions are reluctant to be seen as dependent on American help, have prompted officials to keep the U.S. trainers at arms' length. Some Iraqi officers have been told to skip the police training sessions, the audit said, citing one who blamed "lukewarm relations between the Americans and Iraqis (that) has created some distance between them."

Stephanie Sanok, who was at the U.S. Embassy in Baghdad from 2009 to 2010 and is an expert at the Center for Strategic and International Studies in Washington, called the police training program "doomed from the beginning" because American officials never made sure Iraqis supported it.

"The U.S. government has a tendency to go ahead with programs that it has decreed are in the host country's best interests," Sanok said. "This was such an expensive program, and there was plenty of time to get the Iraqi government to help shape it in such a way that they could eventually take it over. But we never got that buy-in."

KMC On Demand(SM) Launches Custom Online Learning Center ...

ATLANTA, July 26, 2012 /PRNewswire/ --?KMC On Demand, a leading provider of learning technologies and online education for the insurance claims industry, has developed and launched a customized online learning center to train members of the National Association of Catastrophe Adjusters (NACA).

"Ongoing education is a requirement for adjusters so they can perform to the best of their ability in the field," said Wanda Hogan, president of NACA. Toyota passes GM globally, and VW is closing fast

Toyota Motor Corp. regained the lead in global car sales over General Motors Co. in the first half of the year, with Volkswagen AG poised to move past GM and push the U.S. automaker into third place for the full year.

The bigger question is how soon the German auto giant also will pass Toyota and secure the global sales crown ? an internal goal that VW management has targeted for 2018 as part of the company's so-called Strategie 18.

VW, in a cautious statement released Thursday, said: "The Volkswagen Group is right on track for 2018, but has not crossed the finish line yet. For us, quality takes precedence over quantity. We don't want to be the biggest, but rather the best and most sustainable automaker in the world. For us, environmentally friendly products and satisfied customers and employees are at least as important as sales rankings and profitability."

It still has to maneuver past a resurgent Toyota, which has rebounded smartly from the effects of last year's earthquake and tsunami in Japan. Toyota in February said it expects to sell a record 9.58 million vehicles globally in 2012, shattering the old mark of 9.37 million in 2007.

Toyota had held the global sales crown from 2008 through 2010, before the natural disasters in Japan dropped it last year to third place, behind GM and VW.

"We have recovered greatly from the earthquake and tsunami," said Javier Moreno, a spokesman for New York-based Toyota North America. "Our dealers now have plenty of inventory and showroom traffic is up on a global basis."

Toyota said it sold 4.97 million vehicles worldwide in the first six months, a substantial increase from the 3.72 million it sold last year, when all Japanese automakers were reeling from the earthquake's aftermath.

GM said it sold 4.67 million vehicles in the first half, up 3.0 percent from 4.54 million the previous year. GM's global performance was driven by record first-half sales in China, which now accounts for more than 30 percent of the automaker's worldwide total. The U.S. market, where GM's sales are growing at a much slower pace, accounts for only 28 percent of the company's total sales.

GM spokesman James Cain on Wednesday said: "We continue to grow our sales and share in China . . . We are in the early days of the most aggressive roll out of new products in our history, which will help us press our advantage in the U.S. and China and grow profitably around the world."

VW, in a mid-year company report released Thursday, said its first-half sales totaled 4.64 million, up 12.4 percent from 4.13 million last year. But the German auto giant, which recently added sports-car maker Porsche to a diversified brand portfolio that also includes heavy-truck makers MAN and Scania, sounded a note of restraint.

"Deliveries by the Volkswagen Group developed very well in the first half of the year," sales boss Christian Klingler told reporters earlier this month. "But that is by no means cause for euphoria. The economic situation, particularly in Western Europe, remains tense and difficult."

Klingler added: "We remain on track and are entering the second half (of the) year, which will be altogether more challenging, with confidence."

A renewed focus on the U.S. market is part of VW's long-range plan to boost global sales to more than 10 million units by 2018, with the United States contributing at least 10 percent of that volume.

Tom Libby, senior automotive analyst with Southfield, Michigan-based R.L. Polk, said VW's management "has been very aggressive, with the U.S. playing a significant role in their global growth strategy. They have become more competitive on pricing here, and we expect their sales and share will continue to rise."

Genographic project study gives insight into Romanian royal dynasty

WASHINGTONA study by the Genographic Project has shown that not all individuals carrying the Romanian "Basarab" surname, the first dynasty of Wallachian kings that included the real-life Dracula, can be direct biological descendants of the Basarab dynasty.

The Basarab dynasty ruled Wallachia, the historical and geographical southern region of present-day Romania, for almost three centuries (1330-1601) and had among its members Vlad III the Impaler, commonly known as Dracula. The ethnic origin of the Basarab family has long been a dispute among historians, with both an Indo-European/Romanian and an Asian Cuman/Turkic origin being suggested. Published today in the journal PLOS ONE, the research was led by Genographic Project Principal Investigator David Comas of the Genographic Project's Western/Central Europe regional center.

The study analyzed the Y-chromosome diversity of 29 Romanian individuals carrying the Basarab surname and compared it with the diversity found in about 150 Romanians from different regions of the country and some 330 individuals from surrounding populations of Ukraine, Hungary and Bulgaria. Different Y-chromosome lineages were found among the individuals that currently carry the name Basarab, which indicates that not all of them could be direct descendants of the Basarab dynasty. Extra-pair paternity could explain the existence of different male lineages, but the high genetic diversity found in the Basarab individuals indicates that Basarab is most likely a polyphyletic name, with multiple unrelated male founders.

"Patrilineal surnames are common in most European countries and are useful markers for male ancestry to answer questions related to the history and structure of human populations. The study of the Y chromosome in males with the Basarab surname is the first genetic analysis on the surname of a royal dynasty," said Comas.

All Y-chromosome lineages identified in modern-day Romanians bearing the Basarab name have typical Eastern-European haplotypes that were earlier found in both Romanians and Cumans, a population of Asian origin, rather than carrying eastern Asian haplogroups more specific for Cumans. "The present study shows that genetic haplogroup composition of the Basarab is very similar to that of the general Romanian population, and none of the haplogroups they carry is of Central or East Asia. However, these results cannot definitively distinguish between a Cuman or a Romanian origin for the Basarab dynasty, and only genetic analysis of ancient DNA from the actual remains of the Wallachian kings will be able to give a definitive answer," said Genographic Romanian collaborator Mihai Netea.

One certain conclusion, however, based on the relative heterogeneity of Y-chromosome lineages in modern Basarab from Romania, is that the Basarab dynasty was successful in spreading its name beyond the spread of their genes.

Genographic Project Director and National Geographic Explorer-in-Residence Dr. Spencer Wells noted that while the current study failed to find a recent common origin for all of the Basarab men, "There were telltale signs of related lineages among some of the men that suggested a close relationship that probably predated the establishment of the Basarab dynasty. It would certainly be interesting to extend the study of present-day populations to known Basarab remains to see if they belong to these lineages. Although we didn't identify Vlad the Impaler's Y-chromosome signature in this study, it might still be lurking in the dataset, waiting to be teased out with additional analyses."

Genographic Project Director and National Geographic Explorer-in-Residence Dr. Spencer Wells noted that while the current study failed to find a recent common origin for all of the Basarab men, "There were telltale signs of related lineages among some of the men that suggested a close relationship that probably predated the establishment of the Basarab dynasty. It would certainly be interesting to extend the study of present-day populations to known Basarab remains to see if they belong to these lineages. Although we didn't identify Vlad the Impaler's Y-chromosome signature in this study, it might still be lurking in the dataset, waiting to be teased out with additional analyses."

Sarcoma is a term used to describe a whole family of cancers that arise in the body?s connective tissues, which include fat, muscle, blood vessels, deep skin tissues, nerves, bones and cartilage. Drug-related side effects for sarcoma often include nausea, mouth sores and lack of appetite that hinder one?s ability to consume adequate food and/or beverages.

Proper nutrition can help you tolerate treatments better, minimize complications and maintain a better quality of life.? Even if you are overweight, weight loss is not usually recommended during treatment. It boils down to being able to consume enough calories, protein and fluid to maintain your usual weight and muscle strength.

How can one continue to eat and drink sufficiently when appetite is poor or it is painful?

Nausea:

  • Eat something every 2-4 hours to avoid an empty stomach.
  • Eat bland, dry, salty and starchy foods as these are typically easy to digest. This includes toast, saltines, pretzels, rice, etc.
  • Avoid foods with strong odors. Room temperature and cold foods may be better tolerated if aromas bother you.
  • Consider using ginger to calm you queasiness such as ginger sodas, teas, candies or chewing fresh ginger root.
  • Drink small amounts of fluid throughout the day. Dehydration can contribute to nausea or make your symptoms worse. Aim for at least 64-80 ounces of fluid per day.

Lack of appetite:

  • Eat by the clock: set times to eat 3-5 times per day instead of letting hunger dictate when to have your meals.
  • Eat the high calorie, high protein foods on your plate first. Save the low calorie foods such as fruits and vegetables for last if you still have room.
  • If you are experiencing weight loss, try using the full fat, sugar versions of foods to increase calorie intake without increasing the amount of food you are eating. Examples include 2% or whole milk instead of fat-free milk or regular sour cream instead of light or fat-free sour cream.
  • Consider drinking only fluids with calories and/or protein, such as milk, juice, Gatorade?, or popsicles instead of water to meet your fluid needs.

Mouth Sores:

  • Eat soft, bland, room temperature or cool foods such as cream soups, scrambled eggs, custard, yogurt, hot cereal and milkshakes.
  • Avoid foods and beverages such as acidic fruits, vegetables, and juices, lots of spices, crunchy or coarse foods, or carbonated beverages.
  • Rinse often with baking soda mouth wash (4 cups water to 1 tablespoon of baking soda).

Authorities: Suspect bought guns in last 2 months

AURORA, Colo. (AP) ? The four weapons recovered in a mass shooting at a movie theater were purchased by the suspect from retail gun stores in Colorado in the last two months, authorities said Friday.

Police in Aurora, a suburb of Denver, said nearly 7,000 rounds and multiple magazines for those weapons also were purchased online. The suspect, James Holmes, is in police custody.

"My understanding is that all the weapons that he possessed, he possessed legally. And all the clips that he possessed, he possessed legally. And all the ammunition that he possessed, he possessed legally," police chief Dan Oates said at a press conference.

A federal law enforcement officer said Holmes bought one of the four guns ? the first of two Glock pistols ? on May 22 at Gander Mountain in Aurora, Colo. The official spoke on condition of anonymity because the probe into the shootings is ongoing.

Larry Whiteley, a Bass Pro Shops spokesman, said records show that its Denver store followed federal rules in selling a shotgun and a Glock pistol to Holmes.

"Background checks, as required by federal law, were properly conducted, and (Holmes) was approved," Whiteley said in a statement.

Gander Mountain, which sold an AR-15 assault rifle believed to be used in the shootings at a movie theater in Aurora, said the company was in compliance with state and federal laws and that it was "fully cooperating with this ongoing investigation."

A second federal law enforcement official said Holmes had a high-capacity ammunition magazine in the assault rifle. Oates said a 100-round drum magazine was recovered at the scene.

The type of ammunition magazine Holmes is accused of using was banned for new production under the old federal assault weapon ban, said Daniel Vice, senior attorney for the Brady Center to Prevent Gun Violence.

When the ban expired in 2004, gun manufacturers flooded the market with the type of high capacity magazines Holmes used Friday, Vice said.

Oates did not specify the type of rifle, but said that experts told him "with that drum magazine, he could have gotten off 50 to 60 rounds, even if it was semiautomatic, within one minute. And as far as we know, it was a pretty rapid pace of fire in that theater."

Oates said Holmes purchased ammunition over the Internet, including thousands of rounds and multiple magazines for the assault rifle.

Authorities have said that Holmes had on an all-black ensemble of protective gear at the time of the shooting. An online seller of tactical police gear told the St. Louis Post-Dispatch (http://bit.ly/Pssg9H ) that it sold more than $300 of equipment, such as an assault vest, magazine pouches and a knife, to Holmes on July 2.

Chad Weinman, the CEO of Missouri-based TacticalGear.com, said Friday that Holmes had purchased two-day shipping for the items. He said the expedited timing for the items showed "some relevance as to what kind of mindset he was in." A message left after business hours Friday by the Associated Press was not immediately returned.

Holmes is also believed to have hurled two gas canisters into the theater before opening fire.

Holmes' gun purchases include:

? On May 28, six days after purchasing the Glock, Holmes purchased the shotgun used in the shootings from Bass Pro Shops in Denver.

? On June 7, Holmes bought the AR-15 assault rifle at a Gander Mountain store in Thornton, Colo.

? On July 6, Holmes returned to the Bass Pro Shops store in Denver and bought the other Glock pistol.

Dwarf 'kicks' first spiral galaxy

Astronomers have spotted the earliest known spiral galaxy, dating to just three billion years after the Big Bang.

Theories of galaxy formation held that the Universe was still too chaotic a place to allow such a perfectly formed or "grand-design" spiral to form.

It should take far longer for gravity to bring matter into thin, neat discs.

But a team reporting in Nature says the galaxy BX442 got the gravitational "kick" it needed to form a spiral from a smaller "dwarf galaxy" orbiting it.

They first spotted BX442 as the one and only spiral-looking object in a survey of 300 galaxies carried out by the Hubble space telescope, when they were shocked to see what looked to be a spiral galaxy.

"What we've learned when we look at galaxies at that epoch is that they're very dynamically hot," explained lead author of the study David Law from the University of Toronto's Dunlap Institute for Astronomy and Astrophysics.

"Even though we see some discs existing at that time, they're very thick and puffy, whereas the Milky Way has an... amount of random motion only about a tenth or so the amount of ordered rotation, giving rise to a very thin disc," he told BBC News.

To get a closer look at BX442, the team went on to use the OH-Suppressing Infrared Integral Field Spectrograph at the Keck observatory in Hawaii - which can subtract the effect of all the water that lies between the Earth and galaxies at such astronomical distances.

Those observations confirmed a hint apparent in the Hubble data: that BX442 was being orbited by a smaller "dwarf galaxy" at its edges.

"You can get a little extra help if you've got a satellite galaxy orbiting around," explained Dr Law.

"It gives that extra little gravitational kick to help accentuate the strength of the arm and make it into one of those eye-popping examples like the Whirlpool galaxy that you see all the pictures of."

Having proved that such grand-design spiral galaxies can exist at such an early age of the Universe, Dr Law said the team would now like to look into larger, wider-ranging galaxy surveys such as the Hubble telescope's ongoing Candels survey.

(AP) ? Penn State said Tuesday it will respond within days to the NCAA's demand for information as the governing body decides whether the university should face penalties ? including a possible shutdown of its storied football program ? in the wake of the Jerry Sandusky child sex abuse scandal.

Penn State President Rodney Erickson said he doesn't want to "jump to conclusions" about possible sanctions after the head of the NCAA declared the so-called death penalty has not been ruled out.

The NCAA is investigating whether Penn State lost "institutional control" over its athletic program and violated ethics rules. The probe had been on hold for eight months while former FBI Director Louis Freeh conducted an investigation on behalf of the school's board of trustees. Freeh's 267-page report, released last week, asserted that late football coach Joe Paterno and three top officials buried allegations against Sandusky, his retired defensive coordinator, more than a decade ago to protect the university's image.

Sandusky was convicted last month of sexually abusing 10 boys over a 15-year period. He awaits sentencing.

Penn State, with the results of its own investigation in hand, can turn its attention to the NCAA, Erickson said.

"The NCAA has indicated that they'd like me to respond ... as quickly as possible now that we have the Freeh report," he said. "So we've already started the process of starting to compose that response. We'll do so over the course of the next few days and get that response back as soon as possible, and we'll then engage in discussions with the NCAA."

In a PBS interview Monday night, NCAA President Mark Emmert said he's "never seen anything as egregious as this in terms of just overall conduct and behavior inside a university." He said he doesn't want to take "anything off the table" if there's a finding that Penn State violated NCAA rules.

The last time the NCAA shut down a football program was in the 1980s, when Southern Methodist University was forced to drop the sport because of extra benefits violations. After the NCAA suspended the SMU program for a year, the school decided not to play in 1988, either, as it tried to regroup.

Erickson would not say whether he thought Penn State deserved to have its football program yanked.

"Let's not get ahead of ourselves here," Erickson told The Associated Press as he conducted a round of media interviews in his office on Tuesday. "Let's wait for this process to unfold. President Emmert has said that the NCAA will take a deliberate and deliberative process in addressing this, so I don't think we should jump to any conclusions at this point."

Schools often propose sanctions to the governing body. Erickson pointed out that Penn State has already given $2.6 million in bowl revenues to its new center for child abuse research and treatment and to the Pennsylvania Coalition against Rape, a group that operates rape crisis centers across the state.

"We've already started to impose sanctions in the sense that we took away $2.6 million of athletic department funds," Erickson said. "Surely we'll have to do more, but we're already on that road."

Erickson also addressed the controversy swirling around the statue of Paterno outside Beaver Stadium, saying that no decision has been made on whether to take it down. The bronze statue had been a rallying point for students in the months since Sandusky's November arrest.

"I'm still in the process of talking with members of my leadership team," Erickson said. "I'll want to talk with members of the board and others. And we will make a decision, and we will make the right decision based on what we believe is the best course of action for the university."

University spokesman David La Torre said a decision on the matter would be made in seven to 10 days.

Regardless of Penn State's decision on the statue, it's clear that Paterno's name is losing its luster.

Paternoville, a tent city outside Beaver Stadium where students camp out for prime football tickets, was scrapped Monday in favor of Nittanyville. Brown University, the late coach's alma mater, said that not only had it removed Paterno's name from its head football coaching position and a student award, but it's also reviewing whether to remove him from the school's athletic hall of fame, too.

Nike took Paterno's name off a child care center on its corporate campus on Thursday, the day the Freeh report was released. The halo that had floated above Paterno's head in a State College mural was removed Saturday. In its place the artist added a blue ribbon in support of child abuse awareness.

And a Connecticut middle school said it would paint over its own mural of Paterno.

Although there was some negative reaction to Paterno immediately after Sandusky's arrest ? the Big Ten dropped Paterno's name from the conference championship trophy where it had been next to that of Amos Alonzo Stagg, who won almost 100 fewer games ? the pace has picked up since the Freeh report was released.

The Paterno statue, in particular, has been a point of much contention. Critics have called for the sculpture to be taken down after the Freeh report concluded that Paterno was aware of a 1998 allegations against Sandusky ? in contrast to his grand jury testimony and an interview given after his firing ? and that he was involved in the decision to hide a 2001 incident from the authorities.

On Tuesday, a small plane pulled a banner over State College reading, "Take the statue down or we will." The plane is licensed to Air America Aerial Ads of Genoa, Ohio. A person who answered the phone at Air America declined to give his name or identify who paid for the flight.

Federal Aviation Administration records show the agency grounded a plane from the company after it towed banners taunting Tiger Woods during the 2010 Masters golf tournament.

The Freeh report raised the culpability of Paterno and former university President Graham Spanier to the same level as two other key figures: former Vice President Gary Schultz and athletic director Tim Curley.

Schultz and Curley await trial on charges of perjury and failure to report suspected child abuse. They deny the allegations against them.

Spanier is not charged, and his attorneys have criticized the Freeh report, saying it contains inaccuracies. Paterno's family denies he participated in any attempt at a cover-up.

Erickson, who pledged greater transparency after he was named Spanier's successor, called the past eight months "the most difficult and saddest chapter in the university's history" but vowed to make it right.

"We can't rewrite that chapter in terms of what happened in the past, but we are taking responsibility for what happened," he continued. "We're determined to emerge from all of this as a stronger, better university."
