Parents of 'Bully' teen appeal suicide suit dismissal

The parents of a Georgia teen whose suicide was included in the 2011 documentary ?Bully? are appealing a judge's decision to dismiss their federal lawsuit against the Murray County school district, which they blame for his death through ?deliberate indifference? toward years of bullying.

The attorney for David and Tina Long says a notice of appeal was filed June 15, NBC station WRCB of Chattanooga, Tenn., reported.? The Longs? son, Tyler, was found dead on Oct. 17, 2009, hanging by a belt tied to a closet shelf in his room.


Tyler, who had Asperger?s syndrome, had been picked on since the fifth?grade, the Longs claimed. He was unable to comprehend certain facial expressions and body language, so kids would take advantage of him, they said.

The Chatsworth Police Department said?it would?not bring any criminal charges for events leading up to Tyler's?death, WRCB reported?in 2009.??

The Longs in 2010 sued the school district and the principal of Murray County High School in Chatsworth, claiming Tyler killed himself because school officials failed to protect him from the bullying even though middle school and high school administrators had been told of the harassment and of Tyler?s medical conditions.

On May 23, Judge Harold Murphy of the U.S. District Court in Rome, Ga., tossed out the suit in a 186-page ruling favoring the school district:

"Even viewing the evidence in a light most favorable to Plaintiffs, the Court cannot find that Defendants' response was clearly unreasonable, caused additional harassment, or demonstrates an official decision by Defendants not to remedy disability harassment. Under those circumstances, the Court finds that Defendants' actions do not rise to the level of deliberate indifference."

Tina Long ?told WRCB after the ruling, "We're in shock. The judge seemed to agree with us, but has dismissed the case."

The Longs this week told WRCB they are hoping to appeal, but say their ability to fight the case in court could be hampered by a lack of money.

?Based on the ruling, even if a school is aware that a student is being severely abused on an ongoing basis and fails to protect him, they are immune from liability,? the Longs said in a prepared statement. ?Parents all over the country need to know of this ruling. We, as parents, thought that the school was legally obligated to protect our kids, and we vow to try with everything that we have to make that happen."

The Longs' lawyer, W. Winton Briggs, told WRCB in a statement:

"This outrageous ruling and application of the law needs to be exposed. The decision is shocking in that the judge found that Tyler was the subject of ?severe, nearly constant bullying.' The case came to rest on the exceedingly high standard constituting Deliberate Indifference, which needs to be reformed to protect our children.?

Murray County school officials did not immediately respond to msnbc.com requests for comments.

After Murphy?s ruling, defense attorney Martha Pearson said school officials were ?extremely pleased with the result,? the Daily Citizen of Dalton reported.

The film "Bully" features a town meeting hosted by WRCB?in Chatsworth in 2009. The film also traces bullying incidents involving other families from around the United States.

The Longs also took their anti-bullying case to national television, appearing with Ellen DeGeneres on ?Ellen? in March with their twins, Troy and Teryn, who they said are still bullied at school even after Tyler?s death. ?Bully? filmmaker Lee Hirsh also appeared.

7 seconds put Errani in 2nd round; Federer wins

WIMBLEDON, England (AP) ? Count 'em: 7 seconds.

That's how long French Open runner-up Sara Errani "played" at Wimbledon on Wednesday against qualifier CoCo Vandeweghe of Rancho Santa Fe, Calif. ? enough time to wrap up a 6-1, 6-3 victory in the first round.

How's that possible? Because action was suspended by rain a night earlier, with the 10th-seeded Errani at match point as the 132nd-ranked Vandeweghe served.

When they resumed, after the customary several-minute warmup ritual of baseline strokes, volleys, overheads and serves, Vandeweghe tossed up a ball and hit it into the net. Moments later, she hit her second serve into the net, too, to complete the double-fault that ended the match, right then and there ? leaving both women smiling and spectators guffawing. Errani joined in the laughter as she packed away her racket bag, and kept right on giggling during her news conference.

Asked by an Italian reporter to recount what happened, Errani said, justifiably: "There's not much to tell."

Asked by another whether she'd bothered to take a shower, Errani assured him she planned to later.

"I had talked to my coach to plan what I wanted to do in the match," Errani said, "but there was no need."

All in all, it was exactly the sort of unusual happening that Day 3 kept producing in what's shaping up as a wet and wild week at the All England Club. Another: Prince Charles visited his nation's most famous tennis club, something he hadn't done in 42 years.

Four of the top 13 seeded women were sent packing Wednesday, including 2011 U.S. Open champion Sam Stosur, 2011 French Open champion Li Na, and former No. 1-ranked Caroline Wozniacki.

The fifth-seeded Stosur's 6-2, 0-6, 6-4 loss to 72nd-ranked Arantxa Rus of the Netherlands means Australia will have zero men or women in the third round for the first time since 1939.

"It's a pretty woeful performance by all of us," said Stosur, the last of nine Australians in the tournament.

Wozniacki, who hadn't departed any Grand Slam tournament in the first round in more than five years, blew two match points in the second set and was beaten 5-7, 7-6 (4), 6-4 by 37th-ranked Tamira Paszek of Austria. It was the first match of the fortnight played with the Centre Court's retractable roof closed.

"I had over two years where I was winning these matches," said No. 7 Wozniacki, who is dating 2011 U.S. Open golf champion Rory McIlroy and is still seeking her first major title. "I feel lately it's going the other way a little bit. It's not the first match this year where I have match points and not winning. You know, it's frustrating."

No. 11 Li lost to 52nd-ranked Sorana Cirstea of Romania 6-3, 6-4 in a second-round match, and 13th-seeded Dominika Cibulkova was beaten by 31st-ranked Klara Zakopalova of Czech Republic 6-4, 6-1 in the first round.

Adding to the anything-can-happen vibe, at least for the better part of an hour: No. 1 Maria Sharapova trailed 38th-ranked Tsvetana Pironkova throughout the first set, fended off five set points, and was ahead 7-6 (3), 3-1 when their second-round match was suspended by darkness.

That was one of four singles matches halted in progress, while four others were postponed entirely, adding to the backlog created by showers.

Before the rain came, Prince Charles sat in the Royal Box at Centre Court, watching six-time champion Roger Federer stumble once and awkwardly tweak his left knee but otherwise easily reach the third round by beating 68th-ranked Fabio Fognini of Italy 6-1, 6-3, 6-2.

"I'm fine. No pain, which is good," Federer said. "It could be dangerous with the left knee. I'm happy it was only basically a bruise to the ground, and not anything in the knee itself."

Federer and Fognini offered slightly stilted bows on their way off the court. Afterward, Federer chatted with and the Prince of Wales and Duchess of Cornwall for a few minutes, discussing tennis, polo and Federer's young twin daughters.

"They do brief you beforehand," said Federer, owner of a record 16 major championships, but none in the last 2 1/2 years. "I guess you don't do anything stupid. You behave. Obviously we were asked to bow, which is obviously no problem to do."

He said the royals "thought I played great ... which was unnecessary, but of course, I do appreciate it."

His performance was hardly out of the ordinary, of course. Nor was the 6-4, 6-4, 6-4 victory turned in by top-seeded and defending champion Novak Djokovic against 20-year-old American Ryan Harrison under the roof in the day's last match. Or straight-set wins by Andy Roddick to reach the second round and Kim Clijsters to get to the third.

Djokovic's second-round match against Harrison actually was much tighter than the score implies. Each man hit eight aces. Djokovic had one more winner, 31-30, and one more unforced error, 15-14. What made the difference? Djokovic converted 3 of 3 break points, and Harrison went 0 for 6.

"I was in trouble in the second set," Djokovic acknowledged. "It could have easily gone the other way."

But there were other interesting happenings.

Heather Watson, a British player ranked 103rd, became the first woman from the tournament's host country to reach the third round since 2002 by eliminating Jamie Hampton of the United States 6-1, 6-4.

Sloane Stephens, an unseeded 19-year-old American making her main-draw debut at the All England Club, saved five set points in the opener and wound up eliminating No. 23 Petra Cetkovska of the Czech Republic 7-6 (6), 4-6, 6-3. In the third set, Stephens was behind love-30 in four consecutive service games, before coming back to win each of them.

"I do still have some lapses," she said. "They're less now than I used to have in the past. I really don't get as upset when I lose points now. I'm not that emotional anymore."

No. 21-seeded Milos Raonic of Canada needed only slightly longer than Errani to finish off his rain-interrupted victory, coming back after a night's sleep to take the one game he was missing for a 6-4, 6-4, 6-4 defeat of Santiago Giraldo of Colombia. Raonic is scheduled to face Sam Querrey of the United States in the second round Thursday.

Errani is supposed to back out there Thursday, too, facing Anne Keothavong of Britain.

Seems safe to say Errani will need to put in a little more time and effort on court ? weather permitting, of course.

A: Dear Buyer, This is a very difficult market in the distressed arena. It?s not unusual that you might have problems bidding against all cash investors. Normally there are regular sale homes you can investigate, however, I can only speak for my area and city on that. My advice is to continue working with your Buyer Agent. I?m sure your Realtor is putting in many hours trying to find you the perfect home. By the way, my last two sales did take 6 months each to close!

Experimental insulin drug prevents low blood sugar

ScienceDaily (June 25, 2012) ? An experimental insulin drug prevented low blood sugar among diabetic patients more often than a popular drug on the market, a new study finds. The results were presented June 24 at The Endocrine Society's 94th Annual Meeting in Houston.

Nearly 26 million people in the United States have diabetes, which can cause blood sugar, or glucose, to climb to dangerously high levels. While treatment with the hormone insulin can help control blood sugar, it sometimes leads to abnormally low levels, or hypoglycemia. Symptoms of low blood sugar include headaches, tremors, and even seizures, so it is critical to develop medications that control blood sugar without causing extreme drops.

"Diabetes is an increasingly common disease, and many patients fail to achieve their treatment goals due to a fear of hypoglycemia," said lead investigator Daniel Einhorn, M.D., medical director at Scripps Whittier Diabetes Institute, and clinical professor of medicine at the University of California San Diego. "This puts them at risk of developing diabetes complications."

While both medications in this large-scale analysis decreased blood-sugar concentrations, the experimental drug, degludec, caused fewer incidents of low blood sugar, especially at night-time, compared to glargine. Overall, low blood-sugar levels occurred 14 percent less often among degludec patients than among those receiving glargine, also known as Lantus. At night, low blood sugar occurred 37 percent less often among degludec than glargine recipients.

Sixteen weeks after the study, degludec patients had even fewer incidents of low blood sugar. During this maintenance period, the condition occurred 21 percent less frequently, overall, and 43 percent less often at night. No major complications were reported.

"This study suggests that blood glucose can be effectively lowered by degludec, with a lower risk for hypoglycemia compared to currently available insulins," Einhorn said. "It is therefore possible that treatment with degludec can improve patient outcomes by limiting the side effects associated with insulin use."

Investigators analyzed data from seven separate clinical trials. Two of these trials focused on type 1 diabetes, in which the body produces insufficient insulin to control blood-sugar levels. The other five trials examined the most common form of diabetes, known as type 2, in which the body both responds inadequately to insulin and produces inadequate amounts of the hormone.

More than 3,000 participants were randomly assigned to receive either degludec or glargine once a day for 26 or 52 weeks. Of the total number, 2,899 patients received degludec, and 1,431 were given glargine. Nearly half of all patients on both drugs achieved targeted levels of blood-sugar control.

While the investigators are presenting this study for the first time, results from the previous seven trials were previously publicized. Novo Nordisk, the maker of degludec, funded the study.

Turkey turns to NATO after Syria downs jet

ANKARA (Reuters) - Turkey is to demand backing from its NATO allies on Tuesday at a special meeting called after Syrian troops shot down a Turkish warplane last week in an incident Damascus said was self-defense but which Ankara branded an "act of aggression".

It is only the second time in NATO's 63-year history that it has convened under Article 4 of its charter which provides for consultations when a member state feels its territorial integrity, political independence or security is under threat.

Turkey rejected assertions from Damascus that its forces had no option but to fire on the F-4 jet as it flew over Syrian waters close to the coast on Friday.

In a letter to the U.N. Security Council, Turkey condemned the "hostile act by the Syrian authorities against Turkey's national security", saying it posed "a serious threat to peace and security in the region".

Deputy Prime Minister Bulent Arinc told a news conference Syria's actions "would not go unpunished".

The incident has further heightened tensions between Turkey and Syria already strained to near breaking point over the 16-month uprising against Syrian President Bashar al-Assad's rule.

Though not known for his restraint, Turkish Prime Minister Tayyip Erdogan has so far been measured in his response, perhaps due to Western reluctance to commit to any military action and wary himself of anything that could trigger a regional sectarian war.

European Union foreign ministers called on Monday for Turkey to show restraint, saying they would increase pressure on Assad.

"Military intervention in Syria is out of the question," said Dutch Foreign Minister Uri Rosenthal.

After a seven-hour Turkish cabinet meeting in which an air force chief gave a detailed briefing on Friday's incident, Arinc said Erdogan would make an announcement on Syria on Tuesday.

Syria's description of the event as an act of self defense, though tempered with commitment to a "neighborly relationship", seemed likely to further anger Ankara.

ACT OF DEFENCE

"The plane disappeared and then reappeared in Syrian airspace, flying at 100 meters altitude and about 1-2kms (0.6-1.2 miles) from the Syrian coast," Syrian Foreign Ministry spokesman Jihad Makdissi told a Damascus news conference.

"We had to react immediately, even if the plane was Syrian we would have shot it down," he said. "The Syrian response was an act of defense of our sovereignty carried out by anti-aircraft machinegun which has a maximum range of 2.5 km."

Syria warned Turkey and NATO against retaliating.

"NATO is supposed to be there to strengthen countries," said Makdissi. "If their meeting is for hostile reasons (they should know that) Syrian land and waters are sacred."

The only other time NATO has convened under Article 4 was in 2003 to discuss the Iraq war, again at the request of Turkey.

The unarmed reconnaissance jet had briefly entered Syrian airspace as it approached land after patrolling the eastern Mediterranean, Arinc said, but was warned by Turkish radar controllers and immediately left and turned again out to sea. It then made another approach to land when it was shot down 13 miles off the coast in international airspace, he said, out of the reach of Syria's anti-aircraft guns

"According to the data in our hands, it points to our plane being shot by a laser or heat-guided surface-to-air missile. The fact our plane was not given an early radar warning, suggests it was not a radar-guided missile," said Arinc.

By invoking Article 4 of the NATO charter, rather than Article 5 which calls for military action, Turkey has signaled it wants action against Syria short of armed intervention.

"Ankara itself has been averse to consider military action against Syria so far. So it is likely that the invocation of Article 4 is designed to put more diplomatic pressure on Assad," said Clara Marina O'Donnell, a fellow at the Brookings Institution in Washington.

DESERTION

In shell-shattered districts of Homs, the heart of the uprising against Assad, rebels battled troops as aid workers tried to evacuate civilians. Turkish television reported the desertion of a Syrian general and other officers across the border.

The International Committee of the Red Cross (ICRC) said it was again trying to arrange a safe evacuation of trapped civilians from Homs. But anti-government activists reported heavy shelling on central districts, including Jouret al-Shiyah and al-Qarabis. Video showed detonations and machinegun bursts from the skeletal remains of abandoned apartment blocks.

The activist Syrian Observatory for Human Rights said Assad's troops carried out raids and arrests in areas still under army control, and heavy fighting between government forces and rebel fighters was reported in the opposition centers of Idlib, Deir al-Zor and Deraa, the birthplace of the uprising.

The United Nations has said more than 10,000 people have been killed by government forces, while Syria has said at least 2,600 members of the military and security forces have been killed by what it calls foreign-backed "Islamist terrorists."

The intensification of the fighting has raised fears in Turkey of a flood of refugees and a slide into ethnic and religious warfare that could envelop the region. Ankara, like the West, is torn between a wish to remove Assad and the fear that any armed intervention could unleash uncontrollable forces.

Obama?s immigration maneuver could box in Romney, GOP

In the week since President Barack Obama announced a plan that would allow some young undocumented immigrants to stay in this country, Republicans have struggled to embrace any version of immigration reform.

Former Massachusetts Gov. Mitt Romney has fumbled when asked how he would handle such undocumented youths if he were elected president. And Sen. Marco Rubio, who began talking about his own immigration plan for young people this spring but never had a bill in writing, peevishly told national news outlets that the president should have called him.

Obama took an idea similar to his, Rubio said, implemented it through the executive branch, ?and now it?s the greatest idea in the world,? the Florida senator complained Friday in Orlando in a speech to the National Association of Latino Elected and Appointed Officials, a day after Romney spoke to the gathering, and just before Obama himself took the stage.

?I don?t care who gets the credit,? Rubio said. ?I don?t. But it exposes the fact that this issue is all about politics for some people. Not just Democrats, Republicans, too.?

Obama and many Democrats say that Republicans have had ? and still have ? plenty of opportunities to contribute, and are directly responsible for the current state of immigration politics. Senate Majority Leader Harry Reid, a Nevada Democrat, last week accused Republicans, in particular Rubio, of expressing ?phony outrage? over the administration?s policy. The administration?s directive allows young undocumented immigrants who were raised in the United States to remain for two years under a deferred deportation.

?Leading Republican voices on immigration have yet to actually disagree with the decision,? Reid said on the Senate floor. ?The complaints are varied, but they have one thing in common: None of them actually take issue with the substance of President Obama?s directive.?

Republicans could have supported the DREAM Act in 2010, Reid said, when it came up for two votes in the Senate and failed to get the 60 votes needed to proceed to a full vote. And Rubio, Democrats note, could have expressed support for it on the campaign trail, sending a signal to fellow Republicans that the idea had backing from a leading Hispanic political figure. Republicans, for their part, have pointed out that even with Democratic majorities in the Senate and House through 2010, Obama failed at one of his most sweeping campaign pledges: comprehensive immigration reform.

Obama was talking about Romney on Friday, but his message to the NALEO gathering applied to Rubio, too. Six years ago, Obama said, Republican Sen. John McCain, Democratic Sen. Ted Kennedy and President George Bush came together to champion comprehensive immigration reform.

?So to those who are saying Congress should be the one to fix this, absolutely. For those who say we should do this in a bipartisan fashion, absolutely,? Obama said. ?My door has been open for 3?1/2 years. They know where to find me.?

Rubio didn?t start talking about his own proposal until early this spring, shortly after meeting with Daniela Pelaez, the valedictorian and Dartmouth College-bound senior at North Miami High School who faced deportation. Rubio said Friday that when he arrived in the Senate in early 2011, no one wanted to talk about immigration reform because the wounds from the failed 2007 effort and the DREAM Act were still too fresh.

Legal considerations ? machine translation and copyright ? From ...

This guest post is published under a GNU version 2 licence, and comes from the Open Translation Tools Manual (more about that in a forthcoming post). It was written by?Ed Bice in 2009, with modifications by?Thom Hastings also in 2009. Despite being 3 years old, I think it brings up some very interesting topics for discussion. I look forward to reading your comments!

American copyright law considers a translation a derivative work. As such translators must obtain permission from the copyright or derivative right holder of the source language text. With regard to online translation, we expect that as Machine Translation (MT) and Hybrid Distributed Translation (HDT- strategies combining human and machine translation) come of age significant changes will need to be made to the legal framework to accommodate these technologies.

In his excellent research paper, Rebuilding Babel: Copyright and the Future of Machine Translation Online (http://papers.ssrn.com/sol3/papers.cfm?abstract_id=940041), the legal scholar Erik Ketzan posits that Machine Translation (MT) will ?create massive copyright infringement on an unprecedented global scale.? Ketzan argues that ?the law needs to pave the way for companies to develop online translators [MT] and forestall a chilling effect on innovation that may result from legal uncertainty; software companies may not pursue online translators because of the threat of litigation. Online MT needs to be protected because it is socially, politically, and commercially beneficial. Technology may have put man on the moon, but machine translation has the potential to take us farther, across the gulf of comprehension that lies between people from different places.? Ketzan agues the need, ?for protection through the creation of effective licenses and statutory clarification of online MT?s non-infringing nature.?

We believe there is an unmet need for research and legal advocacy addressing the status of both Machine Translation and social translation of webpages and other digital content.

First, though, courtesy of Ketzan, let us take a quick stroll through the history of translation copyright in the West.

Among the notable unfortunate moments in the history of translation copyright, William Tyndale (patron saint of translators) was given neither a take down notice nor a cease and desist but was instead burned at the stake for his unauthorized English translation of the Bible in 1536. [The Radical Reformation xxvii (Michael G. Baylor et al. eds., Cambridge University Press 1991); David Daniel, William Tyndale: A Biography (Yale University Press 1994)] England?s first copyright law, The 1710 Statute of Anne did offer publishing protection for a fixed number of years, but did not protect authors with regard to translation rights. Two 18th Century court cases did address the issue, concluding: ?a translation might not be the same with the reprinting the original, on account that the translator has bestowed his care and pains upon it.? [Burnett v. Chetwood, 2 Mer 441, 35 Eng Rep 1008-9 (Ch 1720) via Ketzan] And, ?Certain bona fide imitations, translations, and abridgments are different [from copies]; and in respect of the property, may be considered new works: but colourable and fraudulent variations will not do.? [Millar v. Taylor, 4 Burr 2303; 98 Eng Rep 201 (1769) via Ketzan] In fact it was not until 1911 that English law granted a work?s author the right to control translations.

Ketzan continues, ?American law did not recognize unauthorized translations as copyright violations until the late nineteenth century. [Naomi Abe Voegtli, Rethinking Derivative Rights, 63 Brook. L. Rev. 1213, 1233 (1997)] In Stowe v. Thomas, a Pennsylvania District Court held that an unauthorized German translation of Uncle Tom?s Cabin (German being commonly spoken in Pennsylvania) did not constitute a ?copy? under copyright law. [Stowe v. Thomas, 23 F. Cas. 201, 207 (C.C.E.D. Pa. 1853) (?A ?copy? of a book must, therefore be a transcript of the language in which the conceptions of the author are clothed; of something printed and embodied in a tangible shape. The same conceptions clothed in another language cannot constitute the same composition, nor can it be called a transcript or ?copy? of the same ?book.? ?)] Congress explicitly reversed this holding in the 1870 Copyright Act, which recognized a form of derivative right in translations by providing that ?authors may reserve the right to dramatize or to translate their own works.? [Act of July 8, 1870, ch. 230 ? 86, 41st Cong., 2d Sess., 16 Stat. 198] The 1909 Act maintained and expanded this translation derivative right, granting authors the right to ?translate the copyrighted work into other language or dialects.??

What emerges from Ketzan?s analysis is a history of translation copyright in which absence of rights followed from the linguistically defined boundaries of the publishing industry of the day. There was no incentive to lobby for translation rights, because the publishing houses did not work across markets. This offers clear analogy to social online translation. The structural fact that content producers (with notable exceptions) are generally not targeting and have no good way of monetizing a single piece of content to a global audience, works to the favor of online translators. Linking a Japanese speaker who has read a lengthy translation of an article from Huffington Post back to that English language site is meaningless to the user and to Huffington post.

Back to a consideration of legal issues related to MT.

The copyright implications of MT have not been addressed by a Federal court in the United States. As mentioned above, the exclusive right to authorize deriviative works belongs to the owner of the copyright. Ketzan: ?It is beyond question that translations constitute derivative works, which are actionable if not authorized by the copyright holder of the original. [7 U.S.C. ? 101 (definition of ?derivative work? includes ?translation?). See also 1-2 Nimmer on copyright, supra note 122, at ? 2.04, ?3.01.] But is MT output actually a ?translation,? and therefore a derivative work, under the Copyright Act? Just as the copyright laws do not expressly require ?human? authorship. [Urantia Found. v. Maaherra, 114 F.3d 955, 958 (9th Cir. 1997) (addressing the bizarre question of whether a book purportedly authored by celestial beings may be copyrighted; ?The copyrightlaws, of course, do not expressly require ?human? authorship?)] Title 17 does not explicitly require translation, or any other derivative work, to be performed by a human. Sound recordings and art reproductions, like MT, can be created at the touch of a single button and create derivative works under ? 101. While an argument can be made that, theoretically, MT is not ?translation,? [Le ton beau de Marot, supra note 40, at 515-518] a plain language reading suggests that machine translation performs what it says: translation. As such, machine translation of a text creates derivative work under the Copyright Act and [an MT service provider] may be liable for copyright infringement if that translation is unauthorized.?

The notion of ?implied license? is a well established concept that a content owner who publishes to the web understands and agrees to enable web crawlers to index their content and web browsers to change their CSS and and fonting. In a Nevada court ruling [Field v. Google, Inc., 412 F. Supp. 2d at 1115-16] it was ruled that the burden is on the website owner to opt out of Google indexing. EG, the web-page owner has the ability to opt out of Google indexing therefore cannot argue that rights are infringed by Google. Currently, Google translation services note to the end user that they should use: <meta name=?google? value=?notranslate?>

The notion of ?fair use? cannot be invoked for translations that constitute full web-page translations due to the fact that one of the considerations for meeting the ?fair use?criterion is ?the amount and substantiality of the portion used in relation to the copyrighted work as a whole.? In the case of a full page machine generated translation, MT fails to meet ?fair use.?

Ketzan asserts that MT service providers could find protection under the Digital Millenium Copyright Act (DMCA), which offers broad immunity to Internet Service Providers (ISPs) for content that might be presented over websites they serve. The question is whether an MT company could be defined as a ?service provider?. The DMCA defines a service provider as ?a provider of online services or network access.? This is perhaps the strongest legal defense for companies that provide provide MT services onto the web.

Social Translation projects such as Global Voices and Meedan.net preform social translation of content on the web (Meedan.net also provides Machine Translation services similar to Google). The projects assert their translation work is a non-commercial public service, they provide links to original sources, and they encourage any content producers who do not want translation services to notify them.

If there was a global equation to describe the velocity of innovation, collaboration, knowledge creation, and knowledge sharing ? a sort of global understanding index ? it would be limited by the scope and rate of the transfer of knowledge and information across language communities. Limiting this flow of information limits our ability to ?compete globally? (to borrow a phrase with irony) against our baser tendencies toward zenophobia, ignorance, and narrow thinking. We need a worldwide agreement that the worldwide web is, indeed, worldwide, and that in publishing a piece of content to the web, we should embrace the idea that people from outside our language have a right to put on a pair of glasses (MT algorithms/HDT services) that might allow them to attempt to decipher our words and ideas. Efforts to restrict translation rights may similarly limit our ability to successfully navigate our inevitably global future.

Plop, Plop, Fizz, Fizz? Oh How Dangerous It Is ?

Heartburn is a primary indicator that your body is not well.

I have very specific memories of being highly acidic prior to my diagnosis of heart disease.

I recall on a daily basis having issues with stomach acid and many nights literally waking up choking on acid reflux.? I was chewing tums, drinking baking soda and googling all kinds of home remedies ? one remedy was to drink a vinegar and mustard mix, not in the least bit enjoyable.? I also would drink huge amounts of milk in an effort to quell the burn; I now understand that was the equivalent of adding gas to the fire.

I cannot possibly encompass all the benefits of maintaining a pH balanced body.? Volumes have been written however we continue to simply look for a quick fix vs. understanding the mechanics of acid reflux.

Acid reflux is highly indicative serious health issues.? A normal body operates in a highly?oxygenated environment and in the year and half of eating a Plant Based diet I have not had one episode of acid reflux.? This includes eating tomatoes, citrus, and spicy foods (cayenne, wasabi, horseradish, hot peppers, etc..)?which are often included in the list of foods to avoid.? I truly believe that animal protein and oil causes 99% of all heartburn episodes.

pH Balanced is a core concept of health and is widely ignored in our day-to-day lives.??Most of us instantly seek instant relief and we are served up a plethora of drugs for?acid reflux.? Unfortunately , Plop, plop, fizz, fizz? is simply a band-aid for a much deeper issues.? Although the drugs are highly effective in relieving symptoms in the short-term they are absolutely not preventative.

The term pH means ?potential of hydrogen? and refers to the amount of hydrogen in a substance. A pH of 7 is considered neutral; anything below is acidic, while anything above a 7 is alkaline. The pH in your blood must remain within a very narrow range, between 7.35 and 7.45 or you become sick and can die. Both metabolic factors and respiratory factors control pH in your blood. Metabolic factors include the breakdown and elimination of waste products normally created by your body. Respiratory factors include the amount of carbon dioxide you elimination from the lungs when you breathe; excess carbon dioxide acidifies your blood.

When you eat too much sugar, processed foods, animal protein and caffeine, your body becomes too acidic. This acidic environment causes your cells to retain less oxygen than they would if you had an alkaline climate within your cells. Consequently, this acidic environment creates an optimal atmosphere for cancer cells to multiply and thrive. Therefore, by following an alkaline diet, you increase the oxygen levels in your cells, which ultimately inhibits the growth and development of cancer cells and might even ?cure? your cancer.? Cancer cannot survive in an oxygen rich environment.

Top?Nine Causes of Acidity

Chocolate:? Chocolate contains caffeine and other stimulants such as theobromine, which cause reflux.? Chocolate is high in fat, and fat causes reflux.

Fried Food:?Fried food is the single most recognized cause of reflux. It is also the food most often associated with heartburn, which is chest pain from esophageal reflux.
Deep-fried (or even not-so-deep-fried) foods are on the ?bad list? because of their high fat content

Alcohol:? Alcohol is believed to relax the valve at the bottom of the esophagus (where it joins the stomach), leading to reflux.

Dairy:? All high-fat foods cause reflux

Meats:? Acid reflux is caused by high-fat cuts of meat?beef, pork, lamb?which stay longer in the stomach and increase the chance of acid reflux.

Caffeine:? Coffee is highly acidic and it can stimulate the hypersecretion of gastric acids. Decaffeinated coffee has been shown to increase acidity to a greater degree than either regular coffee or caffeine alone.? Coffee tends to speed up the process of gastric emptying, which may result in highly acidic stomach contents passing into the small intestine more rapidly than normal.? This may lead to injury of the intestinal tissue

Tobacco:? ?Nicotine increases the production of stomach acid, harming the esophagus. Tobacco smoke seems to directly irritate the esophagus lining,?reducing saliva production. This causes two problems. When you swallow, saliva helps push acid down, out of the esophagus and into the stomach. Saliva also contains bicarbonate, which is a mild acid neutralizer, says Cheskin. So a reduction in saliva can make your acid reflux worse.

Stress:? Although the relationship between stress and symptoms of gastroesophageal reflux is still unclear, evidence suggests that anxiety, along with exhaustion resulting from sustained stress, are both associated with exacerbation of heartburn and esophageal reflux.

Soda:? The bubbles of?carbonation expand inside the stomach and the increased pressure contributes to reflux as well as?draining?affecting bicarbonate levels in the body.? Sodas with caffeine are even worse.

We know that the most significant contributors to over-acidity in the body are acidifying foods such as meat, cheese, certain grains and processed foods, as well as lack of alkalinizing foods such as fruits or vegetables; stress and negative emotions; inflammatory conditions such as arthritis or injury; environmental toxins; pharmaceutical drugs; lack of exercise; dehydration and lack of fresh air. Less emphasis should be placed on acidifying foods such as dairy products, red meats, highly processed and fast?foods, deep-fried foods and hydrolyzed oils.*

Solution

A diet that emphasizes alkalinizing foods is the best way to keep your blood pH in a healthy range. This includes eating fiber rich foods such as whole grains, such as amaranth, quinoa, spelt, rye; fresh fruits and vegetables; sea vegetables such as kelp; essential fatty acids, vitamins and plenty of water. Reducing stress and getting adequate rest are also important steps in maintaining a healthy pH balance. Drinking lots of water, exercise, positive attitudes and fresh air also all have an alkalinizing effect on the body.*
